Keeping staff and students safe

Health and Safety Consultants for Independent Schools

We work with independent schools across the UK, acting as your competent person for health and safety.

Independent schools face a unique combination of risks: complex estates, boarding provision, specialist facilities (science labs, DT, sport), high expectations from parents, and rigorous inspection requirements (ISI or Ofsted for boarding). As a health and safety consultancy, we help by providing the structure, expertise, and assurance that private schools need to operate safely and confidently.

Who We Work With

We help those responsible for keeping independent school students and staff safe, providing expert guidance on compliance, risk management, and staff training.

This includes:

  • Head Teachers
  • Governors
  • Facilities Managers
  • Department Leaders
  • Caretakers
  • Bursars

Key Health and Safety Risks in Independent Schools

Risks in independent and private schools can often be more complex than in other educational settings. Not only due to the scale and character of their estates, but also the breadth of pupil activities, boarding provision, co-curricular programmes and extended use of campus facilities.

We have extensive experience working with independent schools, supporting leadership teams to manage risk effectively while maintaining a safe, well-run environment for pupils, staff and visitors.

  • Pupil and Staff Wellbeing

Independent schools report rising concerns about pupil’s mental health & wellbeing as one of their top sector risks. In addition to this, staff wellbeing is a major challenge, with stress and workload impacting safety and performance.

  • Building & Fire Safety

Independent Schools, commonly located in older, listed buildings, face significant risks from building repairs, estate condition issues, and fire safety requirements.

  • Hazardous Substances

Specialist teaching spaces, such as laboratories and workshops, pose elevated risks due to hazardous substances and equipment requiring strict controls & regulations (e.g. COSHH).

  • Slips, Trips & Falls

These remain the most common source of injuries in education settings, including independent and private schools, and require continual management

Frequently Asked Questions

How do health and safety requirements differ for independent schools?

Independent schools must follow the same core UK health and safety laws (e.g., Health and Safety at Work etc. Act 1974), but the legal “employer” is usually the proprietor or governing body, not a local authority.

This means accountability for policies, risk assessments, staff competence and compliance sits directly with the school’s owners.

They are also inspected specifically against the Independent School Standards, which include welfare, health and safety obligations set by the Department for Education.

What happens if a private school fails a health and safety inspection?

If an inspection finds standards are not met, schools may face:

  • Regulatory or enforcement action by the Department for Education, as inspectors report non‑compliance directly to the Secretary of State.
  • Investigation or prosecution by the Health and Safety Executive (HSE) for serious breaches, which can lead to fines, as seen in cases where hazardous substances or unsafe equipment resulted in injury.

Schools are expected to correct failings immediately and demonstrate compliance or face escalating intervention.

What duty of care do boarding schools have outside teaching hours?

Private boarding schools have an extended duty of care, as pupils are “in the school’s care” beyond the normal school day. Responsibilities often continue off‑site during school‑approved activities and local leave. Courts consider whether the school took reasonable steps to plan, communicate and supervise activities that occur beyond campus.

Parents may also assume a higher level of supervision, making clear systems for sign‑out, monitoring and age‑appropriate supervision essential.

What legal risks do independent schools face after an incident?

After an incident, independent schools may face:

  • Negligence claims if they failed to take reasonable steps to prevent foreseeable harm (e.g., inadequate supervision, unsafe premises, poor equipment).
  • Vicarious liability for staff actions.
  • Health and safety enforcement action or prosecution by HSE for structural, equipment or procedural failings.
  • Safeguarding or Title IX‑type liabilities if they fail to respond adequately to bullying, harassment or violence.

These risks can lead to fines, regulatory action, civil claims and reputational damage.
